Notice to the contractors with detailed instructions, terms and conditions of the tender for provision for supply of diet (tea, breakfast, lunch & dinner) to the indoor patients of S. E. Railway Divisional Hospital, Kharagpur for a period of one year from the date of commencement.

An agreement should be made by and between the President of India acting in the premises through Chief Medical Superintendent, S.E. Railway, KGP on one part and the contractor on the other part, where both the parties agreed as follows:-
1) That tenderer /contractor must have valid trade license/ food license.
2) The contractor must submit copies of documents viz. PAN, IT declaration, Bank Solvency Certificate, Service Tax Code (registration Number), Code Number (registration number) of Employee’s Provident Fund Scheme & E.S.I Scheme, etc with the tender form.
3) That the contractor shall arrange for supply of diet to the indoor patients of S. E. Railway Divisional Hospital, Kharagpur. One diet consists of morning tea & breakfast, lunch, evening tea & dinner. The diets will be of eight categories viz. Bread & Milk diet, Full diet (Non Veg), Full Diet (Veg.), Half Diet (Non Veg), Half Diet (Veg), Diabetic diet (Non Veg), Diabetic diet (Veg) & Light Diet. Schedule of each diet is enclosed at Annexure-II and diet to be prepared as per the schedule. The diet to be supplied at the bed side of the patients. Cost of raw materials and manpower for preparation & distribution of patients, fuel (LPG), gas ovens & utensils, refrigerator, food trolley, transportation charges of raw materials & other items etc will have to borne by the contractor. The cooks and vendors (helpers) will be periodically checked up by Medical Officers of this hospital for further fitness.
4) The schedule time for supply of diet will be as follows:
Morning tea & breakfast: between 07 to 07.30 hrs
Lunch : between 12.00 to 12.30 hrs
Evening tea : between 16.00 to 16.30 hrs
Dinner : between 19.00 to 19.30 hrs     
5) That the contractor should use the existing hospital kitchen of S. E. Rly Divl. Hospital/ KGP for preparation of food. The kitchen building to be used by the contractor exclusively for preparation of diets of inpatients of this hospital. No out side business from this kitchen will be permitted. For using the existing kitchen building following charges will have to borne by the contractor.
a) Rent of the building: Rs. 16,608/- (Rupees sixteen thousand six hundred eight only) per month,
b) Conservancy cess : Rs. 188.00 (Rupees one hundred eighty eight only) per month,
c) Electrical charges: Rs.6,400/- (Rupees six thousand four hundred only) per month according to existing load capacity,
d) Water charges: Rs. 5,400/- (Rupees five thousand four hundred only) per month.      
6) That the contractor will collect the requisition of diet from the Steward of the kitchen in the evening of previous day. Daily around 50 diets are required at present. The required number of diets may increase/ decrease as per the demand from the indoor patients. One log book has to be maintained by the contractor in details regarding diet which will be daily countersigned by the Steward.
7) The quality of the raw materials & prepared meals to be served by the contractor to be of good quality, freshly prepared & hygienic. The quality of food stuff will be monitored by the hospital authority. The raw materials (food stuff) will be examined under quality control as well as PFA Act periodically. An amount of Rs. 1,000/- (Rupees




one thousand only) will be charged towards penalty on each and every occasion if the dietary articles found to be unsatisfactory under quality control. Penalty under PFA Act will be decided by the Food health Authority (minimum of Rs. 2,500/-) on each occasion. An amount of Rs.500/-will be charged as penalty on each & every occasion if diet is not served at scheduled times. Milk should have 3.5% fat & negative for starch and will be tested everyday at the hospital laboratory. An amount of Rs.500/- will charged as penalty on each and every occasion if milk is found to have deficiency of 3.5 % fat. Under no circumstances failure to supply diet will be permitted. However, in the event of failure a penalty of Rs.5,000/- per occasion will be imposed in addition to the actual expenditure incurred by the Rlys for making alternative arrangements. Apart from Medical Officers of this hospital, Food Inspectors/SER/KGP will inspect the kitchen premises periodically and will collect raw materials for examination under quality control & PFA Act.
8) The diet will be tested by the on duty Medical Officer of Casualty Unit before distribution to the patients. If any item is found to be unfit or low quality for human consumption, the contractor has to re-prepare and supply it at his own cost.
9) No further extension / modification of the existing kitchen building will be permitted. The contractor will be responsible for any demurrage & liable to pay demurrage charges to the Rly. authorities.
10) The date of commencement of work will be intimated by the competent authority. On termination of the contract, the contractor shall personally attend to make a final settlement with the Rly authority to receive the final payment with in one month failing which the decision of the CMS/Sr.DMO/DMO or another officer duly authorized as to the amount payable shall be made accordingly and contractor shall have no further Claims against the administration in this respect.
11) The contractor will have to deposit an amount equivalent to 2% of the estimated value of the work i.e., Rs.27,340/- as the earnest money along with the tender form which will be subsequently refunded to the party.
12) (I) The successful tenderer has to submit the Performance Guarantee in the form of a irrevocable bank guarantee amounting to 5 % of the contract value within 15 days from the date of receipt of letter of acceptance.
Deposit may be given in the following forms:-
     a) In cash (on which no interest is payable).
b)Deposit receipt duly endorsed by FA &CAO/S.E.Rly/ Garden Reach/ Kolkata or any scheduled Bank duly certified in writing by Reserve Bank of India.
     c) Government securities @ 5% (five percent) of the market value.
     d) Guarantee Bonds of the Bank Authorized by the Reserve Bank of India.
12(II) Whenever the contractor fails to execute the contract in total or in part and the contract is rescinded, the security deposit will be forfeited and the Performance Guarantee will be encashed and the balance work will be got done separately.
13)(I) The Administration shall have every right to cancel the contract any time without notice, should contractor fail to adhere in full or in part to the terms and conditions of the contract and to recover any loss incurred by Administration due to such defaults on the part of the contractor from the security deposit or any amount due or subsequently may become due to the contractor from the Administration and also to recover of such loss by any legal process. This contract will be governed by the General conditions of contract as envisaged in S.E.Rly schedule of Labors and materials rate, Vol-2 1974(Revised Edition).
13)(II). The Contractor is required to get registered with the Asst. Labour Commissioner(Central) concerned as required under the Contract Labour (Regulation & Abolition Act- 1970-71) and produce the same to this office before




commencement of the work failing which the contract will be terminated on the grounds that the contractor has not complied with legal provisions of the said Act and earnest money forfeited.
14) The contractor will have to initially deposit an amount equivalent to 2% of the tender value as security deposit. The balance Security Deposit as per S.E.Rly Schedule of Labour & Materials Rates Revised Edition-2001, Vol:2, with all correction slips up-to date will be recovered at a percentage deduction of 10% from the periodical payments to be made to the contractor. If for whatever reason the amount of security money is reduced, the contractor shall on demand by the Administration replenish the same within 14 days from the date of such demand, failing which the Administration will have the right to recover the entire money from the remaining bills or any other sums other wise payable to the contractor.
15). The Administration shall have lien over all or any money that may become due and payable to the contractor under these presents and or also on and over the deposit of security amount or made under the contractor and which may become repayable to the contractor under the conditions in that behalf herein contained for or in respect of any debit or sum that may become due and payable to the Administration by the contractor either alone or jointly with another or others and either under this or under any other contract or transaction of any nature whatsoever between the Administration and contractor and further unless the contractor pays and clear the claims of the Administration immediately on demand, the Administration shall at all times be entitled to deduct the said debit or sum from the contractor from the moneys, securities or deposits which may have become or will become payable to the contractor under these presents or under any other contract or transactions whatsoever between the contractor and the Administration.
16) That the contractor shall not sublet, assigns or part with the contract nor shall take any partner or make any other person interested in the contract without prior written consent of the Administration. Any breach by the contractor in respect of this clause will entitle the Administration without prejudice to its any other right or rights to terminate the contract forthwith.
17) Any bribe, commission, gift or advantage offered, proposed or given by or on behalf of the contractor or his agent or servant or any one on his behalf to any officer, servant, representative or agent of the Administration in relation to the obtaining or to the execution of this contract or any other contract with Administration shall in addition to any nominal liability which he may incur, subject the contractor to the cancellation of this contract and he shall also become liable to pay any loss or damage that may be incurred by the Administration as a result of such cancellation.
18) That the contractor shall comply with the provisions of the payment of wages Act.
(Act.4 of 1936) or any statutory modification that have made from time to time and.
rules made hereunder, in respect of workers employed by him in carrying out his contract and he himself and not the Administration, shall be responsible under the said Act for compliance thereof.
19) That the contractor accepts liability for compensation in accordance with the provision of the Indian Workmen Compensation Act., 1923 or any statutory modifications thereof at present in force for personal injury caused to a workman by accident arising out of or during the course of his employment by the contractor in the execution of the work under this contract and shall indemnify the Administration under the said Act.                               
20) That subject as otherwise provided in these contractual notices to be given on behalf of the President of India, all other actions to be taken on his behalf may be given or taken by the Chief Medical Superintendent, S.E.Rly, Kharagpur.





21) ( a) DEMAND FOR ARBITRATION
All disputes and differences of any kind arising out of in connection whether during the currency or after the expiry of the agreement and whether before or after the
     termination of the contract shall be referred to by the contractor to the Administration who shall within a reasonable time after the representation made,notify the decision thereon in writing. The decisions, direction and certification with respect to any matter made by the Administration or by the G.M./S.E.Rly or on behalf of G.M/C.M.D or C.M.S./Sr.DMO. /D.M.O on behalf of the Administration which matter are referred to herein after as “Expected Matters” will be final and binding upon the contractor and shall not be sent aside or be attempted to be sent aside on account of any reason whatsoever and shall be without any appeal.
(b) If the contractor be dissatisfied with the decision of the Administration on any matter in question, dispute or difference or any kind as to the withholding or any decision by the Administration or any certificate which the contractor may claim to be entitled to or if Administration fails to make a decision within a reasonable time then in any such case but except in any or the except the matter as referred to in clause 21(I)(b) thereof, the contractor shall within 10 days of the receipt of the communication of such decision or after the expiry of a reasonable time as the case may be demand in writing that such matter in question, dispute or difference be referred to arbitration. Such demand for arbitration shall specify the matters which are in question, dispute or difference save and except the expected matters of which the demand has been made and no other matter shall be referred to arbitration. The Administration shall have power to scrutinize before referring to arbitration of the matter under demand for arbitration shall have power to scrutinize before referring to arbitration of the matter under demand for arbitration fall within the “Excepted Matter” as referred to in clause 21(I) (b) herein before and the decision of the administration in this regard shall be final and binding upon the contractor. The administration also may at its sole and absolute discretion refer any question, disputes and difference arising out of or in connection with any matter with in agreement to arbitration have and except the “Excepted Matter” as referred to herein before.

OBLIGATION DURING PENDENCY OF ARBITRATION
Supply of vehicle as per the contract shall unless otherwise directed by the Chief Medical Superintendent on behalf of the Administration or by Sr.DMO/DMO shall continue during the arbitration proceedings and no payment due or payable by the Administration shall be withheld on account of such proceedings provided however it shall be open for arbitration to consider and decide whether or not such supply should continue during arbitration proceedings.
III. ARBITRATION
a)     Matters in question disputes or difference to be arbitrated upon irrespective of its nature and value shall be referred for decision to a sole arbitrator who shall be nominated by the General Manager at his own discretion.
b)     There will be no objection if the person appointed as arbitrator is a Govt. Servant and that in course of his duties as Government Servant he had expressed view on all or any of them matter in disputes.
c)     Subject as aforesaid arbitration Act.1940 and the rules there under any statutory modification thereof shall apply to the Arbitration proceedings under this clause.
(22) (I) The contractor shall comply with the provisions of the Contract Labour (Regulation and Abolition) Act 1970 and the Contract Labour (Regulation and Abolition) contract Rules 1971 as modified from time to time, wherever applicable and shall also indemnify the Rly. for any claims under the aforesaid Act and the Rules.




(II) The contractor shall ensure that the drivers employed for the purpose are having a valid driving license and continue to have a valid license until the completion of the work. Any failure to fulfill this requirement shall attract the penal provision of the contract arising out the resultant non-execution of the work.
(III) The contractor shall pay to the driver, helper, etc employed by him directly or through sub-contractor the wages as per provisions of the aforesaid Act and Rules wherever applicable. The contractor shall notwithstanding the provision of the contract to the contrary cause to be paid the wage to labour directly engaged on the work including any engaged by his sub contractors in connection with the said work, as if the labor had been immediately employed by him.           
IV) In respects of all labour directly or indirectly employed for the job for performance of the contractor’s part of the contract, the contractor shall comply with or cause to be complied with the provision of the aforesaid Act and the Rules wherever applicable.
V) In every case in which by virtue of the provision of the aforesaid Act or Rules, the Railway is obliged to pay any amount of wages to a workman employed by the contractor or his sub-contractor in execution of the work or to incur any expenditure in providing welfare/ health amenities required to be provided under aforesaid Act and Rules or to incur any expenditure on account of the contingent liability of the Railway due to contractor’s failure to fulfill his statutory of the Rules, the Railway will recover from the contractor the amount of wages so to the right of the Railway under Section 17 sub-section (2) and Section 18 sub-section(4) of the aforesaid Act., the Railway shall be at liberty to recover such amount or part there of by deducting if from the security deposit and or from any sum due by the Rly. to the contractor whether under the contract or otherwise.
The Railway shall not be bound to contest any claim made against under subsection (I)of
Section 17 and sub-section (4) of Section 18 of the aforesaid Act except on the written
request of the contractor and upon his giving to the Rly. full security for all costs for which the Rly. might become liable in contesting such claim. The decision of the Rly regarding the amount actually recoverable from the contractor as stated above shall be final and binding on the contractor. 20) The Administration also at it’s sole and absolute discretion may cancel the contract at any time without assigning any reasons there of.

vi)     Dressed Chicken to be supplied without neck and below knee portion.
vii)     Fish to be supplied without head, fins & stomach (Rohu/Katla). Fish should not be of less than 1kg in weight.
viii)     Hen’s eggs should be of standard size.
ix)     Fresh & good quality of vegetables and other raw materials to be used
x)     Cow’s Milk should have 3.5% fat & negative for starch.
